Maine Enacts Stricter Telemarketing Law to Protect Consumers

Maine Enacts Stricter Telemarketing Law to Protect ConsumersMaine recently took a significant step to enhance consumer protection in the realm of telemarketing. On March 25, 2024, Governor Janet Mills signed into law LD 2234, introducing amendments to the state's existing telephone solicitation statute. The key provision of this new legislation mandates that telephone solicitors must utilize the Federal Communications Commission’s (FCC) Reassigned Numbers Database (RND) before initiating sales calls to consumers in Maine.

Effective July 16, 2024, this legislation will require all organizations making calls into Maine to diligently query the RND to ascertain whether a consumer's telephone number has been reassigned prior to making a call or sending a text. By mandating this proactive measure, Maine aims to curb the incidence of unwanted and potentially harassing telemarketing calls/texts, thereby bolstering consumer privacy and reducing nuisance for residents.

RealAgent, an authorized caller agent for the RND enables organizations to simply and easily query the RND database – a repository of over 400 million phone numbers that have been permanently disconnected and potentially reassigned to a new user – BEFORE a call or text reaches its recipient. Through this direct access to the RND, RealAgent enables organizations to obtain critical data that helps ensure their calls and texts reach the intended recipients while increasing Safe Harbor protection from State and Federal regulations.
